SECTION 40.1-24.5-2

   § 40.1-24.5-2  General powers and duties ofthe director of mental health, retardation, and hospitals. – (a) The director of mental health, retardation, and hospitals is charged withthe execution of the laws relating to the admission and the care of thementally disabled with respect to this chapter, and is hereby authorized andempowered to do all acts necessary and proper to ensure the comfort and welfareof residents and to protect residents' rights.

   (b) The director of mental health, retardation, andhospitals, or one or more of his or her assistants or representatives sodesignated, may:

   (1) Examine all community residences; and

   (2) Inquire into their methods of government and themanagement of all persons therein; and

   (3) Examine into the condition of all buildings, grounds andother property connected with a community residence and into all mattersrelating to its management.

   (c) The director of mental health, retardation, and hospitalsmay adopt and promulgate such rules and regulations governing the management ofcommunity residences as he or she may deem necessary to carry out theprovisions of this chapter.
