SECTION 40.1-21-15

   § 40.1-21-15  Self-sufficiency trust fund.– (a) There is hereby created the self-sufficiency trust fund. The statetreasurer, ex officio, shall be custodian of the trust fund, and the controllershall direct payments from the trust fund upon vouchers properly certified bythe director of mental health, retardation and hospitals. The treasurer shallcredit interest on the trust fund to the trust fund, and the director shallallocate such interest pro rate to the respective accounts of the namedbeneficiaries of the trust fund. For the purposes of this section, the term"self-sufficiency trust" means a trust created by a nonprofit corporation whichis a 501-C-3 organization under the United States Internal Revenue Code of1954, 26 U.S.C. § 501(c)(3) and which was organized under the NonprofitCorporation Act, chapter 6 of title 7, for the purpose of providing for thecare, or treatment of one or more, persons with disabilities or personsotherwise eligible for department services.

   (b) The department shall adopt such rules and proceduresunder the Administrative Procedures Act, chapter 35 of title 42, as may benecessary or useful for the administration of the trust fund.
