SECTION 40.1-1.1-3
§ 40.1-1.1-3 Powers of department. –The department of mental health, retardation, and hospitals is herebyauthorized:
(1) To develop jointly with the federal government throughits appropriate agency or instrumentality, a plan or plans for the purposespecified in § 40.1-1.1-1 and to make such rules and regulations as may benecessary or desirable for the administration of such plans and the provisionsof this chapter;
(2) To receive and expend in accordance with those plans anyfunds made available to the department by the federal government, the state, orits political subdivision for that purpose;
(3) To develop services and to provide encouragement inassistance of adequate methods of treatment of psychiatric disorders inaccordance with those plans.
