§ 4-1-17 Unloading of animals in transitfor rest, water, and feeding. (a) No railroad company, in the transportation of animals, shall permit thoseanimals to be confined in cars, after they have been confined twenty-eight (28)consecutive hours, without unloading those animals for rest, water, and feedingfor at least five (5) consecutive hours, unless prevented from unloading themby storm or accidental causes. In estimating the confinement, the time duringwhich the animals have been confined without rest on connecting roads fromwhich they are received shall be included. It is the intent of this section toprohibit their continuous confinement longer than twenty-eight (28) hours,except upon the stated contingencies.
(b) Animals unloaded shall be properly fed, watered, andsheltered, during their rest, by the owner or person having the custody of theanimals; or in case of his or her default in doing so, then by the railroadcompany transporting those animals, at the expense of the owner or person incustody of the animals, and the company shall in that case have a lien uponthose animals for food, care, and custody furnished and shall not be liable forany detention of those animals authorized by this chapter.
(c) Any company, owner, or custodian of animals in transitfailing to comply with this section shall for each offense be fined not lessthan one hundred dollars ($100) nor more than five hundred dollars ($500).
(d) Whenever animals are carried in cars in which they canand do have proper food, water, space and opportunity for rest, the provisionsfor unloading them shall not apply.
