   § 36-4-7  Probationary period innoncompetitive branch – Acquisition of full status. – Persons appointed to positions in the noncompetitive branch shall serve aprobationary period of six (6) months during which time the appointingauthority shall report to the personnel administrator every sixty (60) daysconcerning the work of the employee and at the end of the probationary periodno further salary or other compensation shall be paid to the employee unlessthe appointing authority has filed with the personnel administrator astatement, in writing, that the services of the employee have been satisfactoryand that it is desired that his or her services be continued. The probationaryperiod is further defined to be one hundred-thirty (130) days worked in thenon-competitive position to which the person has been appointed. Uponcompletion of the probationary period and receipt of the statement ofsatisfactory service by the personnel administrator and having fulfilled therequirements for character and physical condition, the employee shall be deemedto have acquired full status and shall enjoy all the rights and privileges ofthat status. Whenever a class of positions shall be assigned to thenoncompetitive branch, every employee holding a position in that class at thetime of assignment who is a temporary employee and has served in that class forsix (6) months or more shall be considered to have completed the requiredprobationary period and upon receipt of a statement from his or her appointingauthority that his or her services have been satisfactory shall be deemed tohave acquired full status and shall enjoy all the rights and privileges of thatstatus. A temporary employee who has served at least four (4) months but hasnot completed six (6) months shall be deemed to have served four (4) months ofthe required probationary period and his or her appointing authority shallsubmit a report concerning the work of the employee to the personneladministrator and shall at the end of sixty (60) days submit a finalprobationary report for the employee. An employee who has served at least two(2) months but has not completed four (4) months shall be deemed to have servedtwo (2) months of the required probationary period and his or her appointingauthority shall submit a report concerning the work of the employee to thepersonnel administrator and shall subsequently submit a probationary report atthe end of the next sixty (60) days and a final probationary report at the endof six (6) months of service.
