§ 35-6-4 Uniform system of accounting Enforcing compliance by state departments. (a) If any state department or agency fails to install and maintain the uniformsystem of accounting, or to keep its accounts and interdepartmental records, orrefuses or neglects to make the reports and to furnish the information inaccordance with the method prescribed by the department of administration, orhinders or prevents the examination of accounts and financial records, orhinders or prevents the visits and inspections provided for in this chapter,the department may make a report to the governor in writing, specifying thenature and extent of the failure, refusal, neglect, hindrance, or prevention,and the governor is hereby authorized and directed to review the matter soreported. If the governor shall find that failure, refusal, neglect, hindrance,or prevention exists and that the state department or agency should properlycomply in the matter so reported, the governor shall direct the statedepartment or agency, in writing, to so comply. If the failure, refusal,neglect, hindrance, or prevention shall continue for a period of ten (10) daysfollowing the written direction, the governor shall notify the controller thathe or she shall not, and the controller shall not, draw any order upon thegeneral treasurer for the payment of the salary of any executive officer of thestate department or agency until the prohibition is removed.
(b) Upon compliance with the provisions of this section byany state department or agency which has failed, refused, neglected, hindered,or prevented compliance, the department of administration shall forthwithnotify the governor of compliance and the governor shall notify the controllerthat the prohibition of the payment of salary is removed, and the controllershall thereupon proceed to draw his or her orders on the general treasurer forthe salary of the officer in accordance with law.
