§ 33-11-11 Provision for payment ofcontingent claim not conclusive as to validity Restrictions on action toenforce claim. The decision of the probate court as to depositing assets or giving bond uponthe contingent claim of a creditor shall not be conclusive as to the validityof the claim against the personal representative or other party interested tooppose the allowance thereof; and the personal representative shall not becompelled to pay the claim, unless it is proved to be due in an actioncommenced by the claimant within one year after its claim becomes payable. Incase of suit against the personal representative, recovery shall be limited tothe assets in the registry of the court deposited as provided in § 33-11-9.
