SECTION 31-18-3

   § 31-18-3  Right-of-way in crosswalk.– (a) When traffic control signals are not in place or not in operation, thedriver of a vehicle shall yield the right of way, slowing down or stopping ifneed be to so yield, to a pedestrian crossing the roadway within a crosswalkwhen the pedestrian is upon the half of the roadway upon which the vehicle istraveling, or when the pedestrian is approaching so closely from the oppositehalf of the roadway as to be in danger, but no pedestrian shall suddenly leavea curb or other place of safety and walk or run into the path of a vehiclewhich is so close that it is impossible for the driver to yield. This provisionshall not apply under the conditions stated in § 31-18-6.

   (b) Violations of this section are subject to finesenumerated in § 31-41.1-4 and in addition to any other penalty provided bylaw, a judge or magistrate shall impose a mandatory fine of one hundred dollars($100) for a second or any subsequent violation of this section.
