§ 27-50-9 Periodic market evaluation. Within three (3) months after March 31, 2002, and every thirty-six (36) monthsafter this, the director shall obtain an independent actuarial study andreport. The director shall assess a fee to the health plans to commission thereport. The report shall analyze the effectiveness of the chapter in promotingrate stability, product availability, and coverage affordability. The reportmay contain recommendations for actions to improve the overall effectiveness,efficiency, and fairness of the small group health insurance marketplace. Thereport shall address whether carriers and producers are fairly activelymarketing or issuing health benefit plans to small employers in fulfillment ofthe purposes of the chapter. The report may contain recommendations for marketconduct or other regulatory standards or action.
