§ 27-49-4 Evidence and confidentiality. Any information furnished pursuant to this chapter shall be privileged and nota part of any public record. Except as otherwise provided by law, anyauthorized governmental agency, insurer, or an agent authorized by an insurerto act on its behalf which receives any information furnished pursuant to thischapter, shall not release the information to public inspection. The evidenceor information shall not be subject to subpoena duces tecum in a civil orcriminal proceeding, unless, after reasonable notice to any insurer, agentauthorized by an insurer to act on its behalf, and authorized governmentalagency which has an interest in the information and a subsequent hearing, thecourt determines that the public interest and any ongoing investigation by theauthorized governmental agency, insurer, or an agent authorized by an insurerto act on its behalf will not be jeopardized by compliance with the subpoena orsubpoena duces tecum.
