§ 27-35-6 Confidential treatment. All information, documents, and copies of them obtained by or disclosed to thecommissioner or any other person in the course of an examination orinvestigation made pursuant to § 27-35-5, and all information reportedpursuant to § 27-35-3, shall be given confidential treatment and shall notbe subject to subpoena and shall not be made public by the commissioner or anyother person, except to insurance departments of other states, without theprior written consent of the insurer to which it pertains unless thecommissioner, after giving the insurer and its affiliates who would be affectedby the information, notice and opportunity to be heard, determines that theinterests of policyholders, shareholders, or the public will be served by itspublication, in which event the commissioner may publish all or any part of itin a manner that he or she may deem appropriate.
