§ 23-24.4-5 Employers' responsibility. (a) All employers in the state shall, upon request by the department and inaccordance with the provisions of chapter 21 of title 28 and any amendments tothis chapter, submit, in duplicate, copies of those lists of designatedsubstances and material safety data sheets to the department within thirty (30)working days of receipt of the written request; one copy of which shall bedelivered to the resident making the request subject to § 23-24.4-4 andthe other copy to be placed on file with the department.
(b) When the copies are not received by the department withinforty (40) days of the department's making a request, the department shall haveall enforcement rights available, in accordance with chapter 21 of title 28, toobtain them.
(c) Prior to reimbursement, the employer shall submit astatement of the cost incurred in photocopying the lists of designatedsubstances and associated material safety data sheets.
