§ 23-23-6 Investigation and hearing ofcomplaint of pollution Public disclosure. (a) If the director shall have cause to believe that any person is violatingany provision of this chapter or rule or regulation or any order made underthis chapter, it shall be the duty of the director to cause the matter to beinvestigated. Except as provided in § 23-23-16, before making any findingthat a violation has occurred, that person shall be granted a hearing. At allhearings, the director shall receive evidence and hear witnesses in behalf ofthe person believed to be causing air pollution.
(b) The director shall maintain records concerning allinvestigations undertaken and findings made pursuant to this section. Thoserecords shall be made available for public inspection and shall include thefollowing information:
(1) The names and addresses of persons investigated;
(2) The date or dates of any hearing or hearings conductedwith respect to those persons and the time and place of the hearings;
(3) Any findings made by the director after the conclusion ofthe hearings.
