§ 23-23-14 Penalties. (a) Any person who shall violate an order of the director or any rule,regulation, or other program requirement, or permit, or approval, or any of theprohibitions of this chapter shall be punished by an administrative or civilpenalty of not more than ten thousand dollars ($10,000) and every person shallbe deemed guilty of a separate and distinct offense for each day during whichthe violation shall be repeated or continued.
(b) The director or any agent or employee of the director orany person or his or her agent who shall, except in the enforcement of thischapter or in the performance of official duties under this chapter, discloseany information relating to secret processes or methods of manufacture orproduction obtained in the course of inspecting or investigating any source oralleged source of air pollution, or who shall violate § 23-23-13 shall beguilty of a misdemeanor and shall be punished by a fine not exceeding fivehundred dollars ($500).
(c) Any person obstructing, hindering, or in any way causingto be obstructed or hindered, the director or any agent or employee of thedirector in the performance of their duties or who shall refuse to permit thedirector or any of his or her agents entrance into any premises, buildings, orother places belonging to or controlled by that person in the performance ofhis or her duties, or who shall refuse to furnish the information requested orto make a test provided for in this chapter shall be guilty of a misdemeanorand shall be fined not more than five hundred dollars ($500).
(d) Any person convicted under the provisions of §23-23-11 shall be punished by a fine of not more than ten thousand dollars($10,000) or by imprisonment of one year, or both fine and imprisonment, andevery person shall be deemed guilty of a separate and distinct offense for eachday during which the violation shall be repeated or continued.
(e) Any person who knowingly makes a false statement,representation, or certification in any application, record, report, plan,permit, or document filed, maintained and used for purposes under this chaptershall be guilty of a felony, and shall be punished by a fine of not more thanten thousand dollars ($10,000) or by imprisonment of one year or both fine andimprisonment, and every person shall be guilty of a separate and distinctoffense for each day during which the violation shall be repeated or continued.
