§ 23-23-10 Prosecution of violations Relief in equity or by prerogative writ. (a) All prosecutions for criminal violations of any of the provisions of thischapter or any of the rules and regulations shall be by information orindictment and shall be commenced in the superior courts of the state. Thedirector, without being required to enter into any recognizance or to givesurety for cost, shall institute those proceedings in the name of the state. Itshall be the duty of the attorney general to conduct the prosecution of all theproceedings brought by the director.
(b) The director may obtain relief in equity or byprerogative writ whenever that relief shall be necessary for the properperformance of his or her duties under this chapter. The superior court shallhave the jurisdiction in equity to enforce the provisions of this chapter andany rule or regulation or order made by the director in conformity with thischapter. Proceedings under this section shall follow the course of equity andshall be instituted and prosecuted in the name of the director by the directoror the attorney general, but only upon the request of the director.
