§ 23-17.8-11 Records of the department ofhealth. – In any administrative, civil, or criminal proceeding in which the status of thelicense of any facility which is licensed or was licensed by the department ofhealth is in issue, certified copies of relevant documents on file with thedepartment and the certified statement of the director, his or her equivalentor his or her duly appointed designee as to the status of the license, shall beadmissible as evidence of the status of the license, subject to the right ofthe defendant to subpoena these records in rebuttal. Upon request, copies shallbe provided to the person or his or her counsel at least three (3) days beforethe proceeding.
