§ 23-17.4-33 Disclosure of financialinterest. – (a) Any licensed assisted living residence which refers clients to any healthcare facility licensed pursuant to chapter 17 of this title or to anotherassisted living residence licensed pursuant to this chapter or to a certifiedadult day care program in which the referring entity has a financial interestshall, at the time a referral is made, disclose the following information tothe client: (1) that the referring entity has a financial interest in thefacility or provider to which the referral is being made; (2) that the clienthas the option of seeking care from a different facility or provider which isalso licensed and/or certified by the state to provide similar services to theclient. The referring entity shall also offer the client a written listprepared by the department of all alternative licensed and/or certifiedfacilities or providers.
(b) Noncompliance with this section shall constitute groundsto revoke, suspend or otherwise discipline the licensee or to deny anapplication for licensure by the director, or may result in imposition of anadministrative penalty in accordance with chapter 17.10 of this title.
