§ 23-17.4-10 Regulations, inspections, andinvestigations. (a) The licensing agency shall after public hearing pursuant to reasonablenotice, adopt, amend, promulgate, and enforce any rules, regulations, andstandards with respect to assisted living residences for adults licensed underthis chapter as may be designed to further the accomplishment of the purposesof this chapter in promoting safe and adequate living environments forindividuals in assisted living residences in the interest of public safety andwelfare. These regulations may provide for the establishment of levels ofservice provided by the residence.
(b) In addition to the annual inspection required by §23-17.4-7, the licensing agency shall make or cause to be made any inspectionsand investigations that it deems necessary by duly authorized agents of thedirector at any time and frequency determined by the licensing agency. Thelicensing agency shall establish regulations to determine the frequency ofinspections that shall include, but not limited to, the residence's pastcompliance with regulations, complaint investigations, quality of care issuesand license type.
(c) Upon request of the licensing agency, health agencies andprofessionals may share resident health status information with the departmentof health for the purpose of determining each resident's capability of selfpreservation.
(d) Each assisted living residence licensed under thischapter shall have a plan for preventing the hazards of resident wandering fromthe facility. This plan shall be submitted to the licensing agency in a formatdetermined by the director.
