§ 23-17.10-2 Authority of the director toassess penalty. – The director may assess an administrative penalty on a person who fails tocomply with any federal requirements for participation in the Medicare orMedicaid program, any provision of chapter 17 of this title as the provisionrelates to skilled nursing or intermediate care facilities, any provision ofchapter 17.5 of this title, any rule, regulation, order, license, or approvalissued or adopted by the director relating to skilled nursing or intermediatecare facilities, or any rule, regulation, or order regarding the management ofinfectious waste in health care facilities. The penalty shall be deemed to beconcurrent with any other civil penalty that may be prescribed by law.
