§ 23-1-5.7 Well water purificationlicensing. (a) The director of the department of health shall promulgate rules andregulations for the licensing of well water purification companies. The rulesshall include minimum qualifications for testing and analysis of wells andshall set forth comprehensive criteria for the distribution of chemicals usedin the treatment of drinking water and potable well water. Upon promulgation ofthe rules, no person, firm, partnership, or other business association shallengage in the business of well water purification without first obtaining alicense from the director of health. The director may revoke the license forjust cause. The director may charge an appropriate license or registration feeto cover administrative costs.
(b) The licensing provisions of this section shall not applyto state employees carrying out official business of the state. The regulationsissued under this section shall not apply to the design, installation, andoperation of recovery wells utilized to treat contaminated groundwater providedthat this activity is authorized by the department of environmental managementand that the wells are not used for drinking water purposes.
