§ 21-27.1-3 Plastic recycling and littercommission. (a) There is created a permanent commission consisting of thirteen (13)members: one of whom shall be the director of the department of environmentalmanagement or his or her designee, who shall act as chairperson of thecommission; one of whom shall be the director of the solid waste managementcorporation or his or her designee; one of whom shall be the chairperson of thesource reduction task force or his or her designee; one of whom shall be astate senator appointed by the president of the senate; one of whom shall be astate representative appointed by the speaker; one of whom shall be arepresentative of the plastic packaging industry, appointed by the governor;one of whom shall be a distributor of plastic oam food service products,appointed by the lieutenant governor; one of whom shall be a retailer who sellsplastic oam food service products, appointed by the president of the senate;one of whom shall be a fast food service representative or owner, appointed bythe speaker; one of whom shall be a representative of a hospital or hospitalorganization, appointed by the governor; two (2) of whom shall berepresentatives of environmental groups involved with litter issues; one ofwhom shall be appointed by the lieutenant governor and the other appointed bythe president of the senate; one of whom shall be a representative from aneducational institution food service, appointed by the speaker.
(b) The purpose of the commission shall be to produce a planwhich will provide for the maximum recycling of plastic and foam food serviceproducts. For those products which cannot be recycled, the commission willdevelop guidelines for the use of photodegradable and biodegradable productswherever feasible.
(c) The commission shall monitor the plan and guidelines andstudy and update its findings and recommendations on a continuing basis.
