SECTION 2-7-7

   § 2-7-7  Inspection, sampling, analysis.– (a) It is the duty of the director, who may act through his or her authorizedagent, to sample, inspect, make analysis of, and test commercial fertilizersdistributed within this state at any time and place and to the extent thedirector deems necessary to determine whether commercial fertilizers are incompliance with the provisions of this chapter. The director, individually orthrough his or her agent, is authorized to enter upon any public or privatepremises or carriers during regular business hours in order to have access tocommercial fertilizers subject to the provisions of this chapter and the rulesand regulations pertaining to this chapter, and to the records relating totheir distribution.

   (b) The methods of analysis and sampling are those adopted bythe fertilizer quality testing laboratory in consultation with the directorfrom sources such as the journal of the association of official analyticalchemists.

   (c) The director, in determining for administrative purposeswhether any commercial fertilizer is deficient in plant food, shall be guidedsolely by the official sample as defined in § 2-7-3(13) and obtained andanalyzed as provided for in subsection (a).

   (d) The results of official analysis of commercialfertilizers and portions of official samples shall be distributed upon requestby the dean of the college of resource development at the University of RhodeIsland as provided in the regulations.
