§ 15-8-5 Limitations of recovery fromfather's estate. – (a) The obligation of the estate of the father for liabilities under§§ 15-8-1 – 15-8-26 are limited to those amounts accrued priorto his death. In order to hold the estate of the father liable under§§ 15-8-1 – 15-8-26, an action under the provisions of thischapter must have been commenced during the lifetime of the father.
(b) This section shall in no way limit the provisions of§ 33-1-8, permitting the inheriting or transmitting inheritance by a childborn out of wedlock.
