§ 12-9-30 Execution of waiver ofextradition. Any person arrested in this state charged, with having committed any crime inanother state, or alleged to have escaped from confinement or broken the termsof his or her bail, probation, or parole, may waive the issuance and service ofthe warrant provided for in §§ 12-9-9 and 12-9-10 and all otherprocedure incidental to extradition proceedings, by executing or subscribing inthe presence of a judge of any court of record within this state a writingwhich states that he or she consents to return to the demanding state;provided, that before the waiver shall be executed or subscribed by the personit shall be the duty of the judge to inform the person of his or her rights tothe issuance and service of a warrant of extradition and to obtain a writ ofhabeas corpus as provided for in § 12-9-12.
