§ 11-47-45 Arrest and detention forpossession of weapon prohibited by § 11-47-42. – Every officer authorized to make an arrest for any criminal offense may arrestwithout complaint and warrant any person who has in his or her possession anyinstrument or weapon described in § 11-47-42 whenever the officer hasreasonable ground to suspect that the person possesses, or is using, wearing orcarrying the instrument or weapon contrary to law. Any person so arrested maybe detained a reasonable time, not exceeding twenty-four (24) hours, for thepurpose of making an investigation concerning the person, but no person soarrested shall be detained longer than twenty-four (24) hours without complaintbeing made against him or her before some proper court or justice. If theofficer making the arrest shall at any time within the twenty-four (24) hourssatisfy himself or herself that there is no ground for making a criminalcomplaint against the person, he or she shall be discharged from custody.
