§ 1-3-10 Purchase or condemnation of airrights. – In any case in which:
(1) It is desired to remove, lower, or otherwise terminate anonconforming use; or
(2) The approach protection necessary cannot, because ofconstitutional limitations, be provided by airport zoning regulations underthis chapter; or
(3) It appears advisable that the necessary approachprotection be provided by acquisition of property rights rather than by airportzoning regulations,
the political subdivision within which the property ornonconforming use is located or the political subdivision owning the airport orserved by it may acquire, by purchase, grant, or condemnation in the mannerprovided by the law under which political subdivisions are authorized toacquire real property for public purposes, any air right, easement, or otherestate or interest in the property or nonconforming use in question as may benecessary to effectuate the purposes of this chapter.
