4373 - Administration of Title IV-D program.

     § 4373.  Administration of Title IV-D program.        (a)  Parent locator service.--The department shall maintain a     parent locator service for the purpose of establishing     parentage, for establishing, setting the amount of, modifying or     enforcing child support, establishing or enforcing visitation or     custody orders and locating legally responsible relatives. The     locator services shall utilize all sources of information and     legally available records. In addition, the department shall     utilize the parent locator service of the Federal Government     pursuant to Federal law and shall only make disclosures of     information to individuals as provided by Federal law.        (b)  Cooperative agreements.--The department shall undertake,     either directly or pursuant to cooperative arrangements with     appropriate counties, courts or law enforcement officials,     including domestic relations sections, to do all of the     following:            (1)  Establish paternity of children with respect to whom        assistance has been received.            (2)  Secure support for children under paragraph (1) from        a legally responsible relative.            (3)  Determine whether the applicant or recipient is        cooperating in good faith with matters set forth in section        4379 (relating to cooperation required).            (4)  Notify the applicant or recipient of each        noncooperation determination and the basis for such        determination.            (5)  Make available child support and paternity        determination services to any individual not receiving        assistance to the extent required by Federal law and upon        application submitted to the department on forms provided by        the department, the payment of any application fee        established by the department and the agreement to pay costs        in excess of any fee out of any recovery made by the        department.        (c)  Incentive payments.--The department shall make incentive     payments to political subdivisions and other states consistent     with Federal law whenever the political subdivision or other     state enforces or collects support payable to the department.
