8515 - Execution by judicial act.

     § 8515.  Execution by judicial act.        (a)  General rule.--If a person required by this chapter to     execute any certificate fails or refuses to do so, any other     person who is adversely affected by the failure or refusal may     petition the court to direct the execution of the certificate.     If the court finds that it is proper for the certificate to be     executed and that any person so designated has failed or refused     to execute the certificate, it shall order the Department of     State to record an appropriate certificate. The clerk of the     court shall file a certified copy of the order (which shall     include the full text of the certificate) in the department.        (b)  Effectiveness of judicial order.--Upon the filing of the     judicial order of amendment in the department or upon the     effective date specified in the certificate, whichever is later,     the certificate shall be effective.
