PROCEDUREFOR PAYMENT OF SALARY AND EXPENSES OF STATE OFFICERS AND EMPLOYEES
292.010Salaries of state officers and employees payable monthly or biweekly. The salaries ofthe Governor, Secretary of State, State Treasurer, Attorney General, judges ofthe Supreme and circuit courts, district attorneys, and all other stateofficers, and all persons employed by the state whose salary or compensation ispayable by law out of the State Treasury, shall be paid monthly or on abiweekly basis. 292.014Definitions for ORS 292.014 to 292.036. As used in ORS 292.014 to 292.036:
(1)“Authorized employee deductions” includes all authorized deductions made fromthe salary and wages of an officer or employee of a state agency.
(2)“Salaries and wages” means payments to officers and employees of a state agencyfor services rendered other than on a fee basis. [1955 c.495 §1; 1961 c.108 §9]
292.016Centralized payroll procedure. The salaries and wages of the officersand employees of any state agency whose salaries and wages are payable out ofthe State Treasury shall be paid through the medium of payrolls as provided inORS 292.014 to 292.036. [1955 c.495 §2; 1969 c.378 §2]
292.018Designation of agent.The chief administrative officer of any state agency electing to use theprocedure provided by ORS 292.014 to 292.036 shall designate the OregonDepartment of Administrative Services as an agent to act for the chiefadministrative officer under ORS 292.014 to 292.036. The designation shall bein writing signed by the chief administrative officer of the state agency andfiled with the department. The designation shall remain in effect until thechief administrative officer of the state agency revokes it by written noticeto the department. [1955 c.495 §3]

292.022Preparation of payroll. (1) The chief administrative officer of the stateagency using the procedure provided in ORS 292.014 to 292.036 shall cause to beprepared payrolls in the form prescribed by the Oregon Department ofAdministrative Services.
(2)The payroll shall be certified as correct by the chief administrative officerof the state agency or by the officer designated pursuant to ORS 293.330 toapprove disbursements for the state agency.
(3)The payroll in a form acceptable to the department shall be transmitted to thedepartment. [1955 c.495 §4; 1967 c.454 §80; 1969 c.378 §3; 1979 c.468 §32]
292.024Warrant for aggregate amount allowed plus assessments; limits. (1) The OregonDepartment of Administrative Services shall, as it determines and may at anytime redetermine, either draw a warrant for or transfer the aggregate amountallowed of a payroll transmitted under ORS 292.022 plus additional amountsspecified in subsection (2) of this section. The aggregate amounts allowedshall be deposited with the State Treasurer, to be held in a special account tobe designated as the Joint Payroll Account.
(2)In addition to the aggregate amount allowed of a payroll in subsection (1) ofthis section, the department may assess a fee equal to the State Treasury shortterm investment pool interest rate against any portion of any payrollreimbursement the source of funds of which is other than from a General Fundappropriation, and which is transmitted to the department 45 or more days afterthe issue date of the payroll. All moneys received by the department under theprovisions of this subsection shall be deposited in the State Treasury to thecredit of the General Fund. 292.026Issuing payroll checks. (1) After preparation of the payroll, the aggregateamount as prescribed by ORS 292.024 shall be deposited in the Joint PayrollAccount. The Oregon Department of Administrative Services may issue checks inthe proper amount even though reimbursement funds payable to the Joint PayrollAccount are not available on the date of issuance. The checks shall be drawn onthe State Treasurer and be payable from the Joint Payroll Account. The checksshall be issued to:
(a)The officers and employees of the state agency who are entitled to receivepayments under the payroll as allowed by the department.
(b)The persons, public or private, including persons responsible for holding orinvesting an officer or employee’s individual retirement account, section 408,Internal Revenue Code of 1954, in effect on January 1, 1987, entitled toreceive the authorized employee deductions under the payroll as allowed by thedepartment.
(c)Banks, savings and loan associations or credit unions, including personsresponsible for holding or investing an officer or employee’s individualretirement account entitled to receive direct deposit of payroll checks aspreauthorized by employee.
(2)Checks issued under subsection (1)(b) or (c) of this section may be for theaggregate amount due under the payroll to the person, public or private,entitled to receive the money or the department may utilize an automatic orelectronic transfer of funds system authorized by the State Treasurer’s officein lieu of issuing checks. The department may, where monthly payments are notrequired, issue checks less frequently than monthly to the persons, public orprivate, entitled to receive payments under subsection (1)(b) of this section. 292.032Filing paid checks; unpresented checks. Checks issued under ORS 292.026, afterhaving been paid, shall be filed with the chief administrative officer of thestate agency. Unpresented checks shall be treated as are unpresented checksunder ORS 293.450 to 293.460. [1955 c.495 §8]
292.033Advances of regular and terminal salary or wages. (1) As used inthis section:
(a)“Regular salary advance” means any portion of the accrued salary or wagespayable to an officer or employee who has filed a written request for theapproval of such advance with the administrative head of the state agency bywhich the employee is employed.
(b)“State agency” means a state agency using the procedure provided in ORS 292.010to 292.036.
(c)“Terminal salary or wages” means the salary or wages payable to an officer oremployee who is terminating the office or employment with the state andincludes cash payments made in lieu of accrued vacation time.
(2)Where a state agency does not have an alternative procedure for advances ofregular salary or wages or terminal salary or wages, the Oregon Department ofAdministrative Services may make advances of regular salary or wages orterminal salary or wages to an officer or employee of a state agency by checkdrawn on the Joint Payroll Account. The provisions of ORS 292.032 apply to suchchecks. The department shall require the officer or employee to whom theadvance is made to execute an assignment of regular salary or wages or terminalsalary or wages in the amount of the advancement. The assignment shall be madeto the department. The assignment shall have priority over any other claimsagainst the regular salary or wages or terminal salary or wages owed to theofficer or employee by the state. The department shall withhold the amountspecified in the assignment from the next salaries or wages or the terminalsalary or wages payable to such officer or employee, and the amount so withheldshall be credited to the Joint Payroll Account in payment of the advance madeunder this section. 292.034Payment for use of centralized payroll services. (1) A stateagency using the procedure provided by ORS 292.014 to 292.036 shall pay for theexpense of the services (including labor), facilities and materials furnishedby the Oregon Department of Administrative Services under ORS 292.014 to292.036.
(2)All moneys received by the department under the provisions of this sectionshall be deposited in the State Treasury to the credit of the Oregon Departmentof Administrative Services Operating Fund. [1955 c.495 §9; 1961 c.108 §12; 1967c.454 §83; 1969 c.378 §7; 1993 c.500 §44a]
292.036Rules.The Oregon Department of Administrative Services may prescribe such rules andregulations as are necessary to carry out the provisions of ORS 292.014 to292.036. [1955 c.495 §10]
