§ 99E‑30. Definitions.
As used in this Article, thefollowing terms mean:
(1) Agritourismactivity. Any activity carried out on a farm or ranch that allows members ofthe general public, for recreational, entertainment, or educational purposes,to view or enjoy rural activities, including farming, ranching, historic,cultural, harvest‑your‑own activities, or natural activities andattractions. An activity is an agritourism activity whether or not theparticipant paid to participate in the activity. "Agritourismactivity" includes an activity involving any animal exhibition at anagricultural fair licensed by the Commissioner of Agriculture pursuant to G.S.106‑520.3.
(2) Agritourismprofessional. Any person who is engaged in the business of providing one ormore agritourism activities, whether or not for compensation.
(3) Inherent risks ofagritourism activity. Those dangers or conditions that are an integral partof an agritourism activity including certain hazards, including surface andsubsurface conditions, natural conditions of land, vegetation, and waters, thebehavior of wild or domestic animals, and ordinary dangers of structures orequipment ordinarily used in farming and ranching operations. Inherent risks ofagritourism activity also include the potential of a participant to act in anegligent manner that may contribute to injury to the participant or others,including failing to follow instructions given by the agritourism professionalor failing to exercise reasonable caution while engaging in the agritourismactivity.
(4) Participant. Anyperson, other than the agritourism professional, who engages in an agritourismactivity.
(5) Person. Anindividual, fiduciary, firm, association, partnership, limited liabilitycompany, corporation, unit of government, or any other group acting as a unit. (2005‑236, s. 1; 2007‑171,s. 1.)
