§ 95‑69.15. Classification of inspectors; qualifications; examinations; inspector'scommission.

(a)        There shall bethree types of inspectors authorized to conduct inspections and report theirfindings to the Chief Inspector under this Article:

(1)        Boiler and PressureVessel Inspector or Deputy Inspector. – Shall be a qualified individual,employed by the Department of Labor and appointed by the Commissioner, toassist in conducting inspections under this Article and report on thesuitability of boilers and pressure vessels so inspected.

(2)        Special Inspector orInsurance Inspector. – Shall be a qualified individual regularly employed by aninsurance company authorized to insure in this State against injury to personor property or both from explosions and accidents involving boilers andpressure vessels. Special Inspectors shall not include employees of privatecontract inspection agencies.

(3)        Owner‑UserInspectors. – Shall be a qualified individual employed on a full‑timebasis by a company operating pressure vessels for its own use and not forresale, and maintains an established inspection program for periodic inspectionof pressure vessels owned or used by that company and where such inspectionprogram is under the supervision of one or more engineers having qualificationssatisfactory to the Commissioner.

(b)        Inspector'sCommission. – Any company authorized to insure in this State against loss toperson or property as a result of an explosion or accident involving boilersand pressure vessels or operating boilers or pressure vessels or both for itsown use and not for resale, may apply for the issuance of an inspector'scommission for an individual within its employ who has a commission from theNational Board.

A North Carolina commissionauthorizes an inspector to make inspections on boilers and pressure vessels andreport on the suitability of said boilers and pressure vessels to the ChiefInspector. Those inspectors holding commissions as special inspectors shall belimited to making inspections on boilers and pressure vessels insured by theiremployer. Owner‑user inspectors shall be limited to conductinginspections on boilers and pressure vessels operated by their respectiveemployers.

A person seeking a commissionfrom this State to conduct in‑service inspections of boilers and pressurevessels must take and pass an examination on this Article and the rules adoptedpursuant to this Article prior to receiving the commission. Any person who hashad a commission in this State but who has been inactive for more than one yearmust take or retake and pass the State examination before conducting further in‑serviceinspections of boilers and pressure vessels.
