§95‑47.26. Advertising and publication.
(a) In conducting any form ofadvertising, a job listing service shall identify itself by its business nameand identify itself as a job listing service by using in the name or elsewherein the advertising the term "job listing service."
(b) Prior to advertising orpublishing information about an available job, a job listing service shallreceive a job order and shall record the job order, the date it was receivedand the name of the employer representative or other business who gave the joborder to the job listing service. No description or representation of anemployment position shall be stated in any advertising or other publication,unless the information is included on the recorded job order for the position.Information about a single employment position shall not be used in more thanone advertisement or listing in a single issue of any publication.
(c) A job listing serviceshall not publish or cause to be published any information which it knows orreasonably ought to know is false or deceptive or which it has no reasonablebasis for believing to be true.
(d) In conducting any form ofadvertising, a job listing service shall not use the term "no fee" orany other term indicating that applicants will not be financially obligated tothe job listing service. (1979, c. 780, s. 2.)
