§90A‑22. Classification of water treatment facilities; notification ofusers.
(a) On or before July1, 1982, the Board of Certification, with the advice and assistance of theSecretary of Environment and Natural Resources, shall classify all surface watertreatment facilities and all facilities for treating groundwater supplies thatare used, or intended for use, as part of a public water supply system with dueregard for the size of the facility, its type, character of water to betreated, other physical conditions affecting the treatment of the water, andwith respect to the degree of skill, knowledge, and experience that theoperator responsible for the water treatment facility must have to supervisesuccessfully the operation of the facilities so as to adequately protect thepublic health.
(b) The Board shallnotify users of such facilities when any classification of a facility by theBoard would result in a certified operator's not being required to supervisethe operation of that facility. Any user so notified may demand a hearing onthe Board's decision, and that hearing and any appeal therefrom shall beconducted in accordance with Articles 3 and 4 of Chapter 150B of the GeneralStatutes.
