§ 87‑13.1. Board mayseek injunctive relief.
Whenever the Board determinesthat any person, firm or corporation has violated or is violating any of theprovisions of this Article or rules and regulations of the Board promulgatedunder this Article, the Board may apply to the superior court for a restrainingorder and injunction to restrain the violation; and the superior courts havejurisdiction to grant the requested relief, irrespective of whether or notcriminal prosecution has been instituted or administrative sanctions imposed byreason of the violation. The court may award the Board its reasonable costsassociated with the investigation and prosecution of the violation. (1979, c. 713, s. 4; 2003‑97,s. 2; 2005‑381, s. 5.)
