§ 7B‑1402. Task Force creation; membership; vacancies.
(a) There is createdthe North Carolina Child Fatality Task Force within the Department of Healthand Human Services for budgetary purposes only.
(b) The Task Forceshall be composed of 35 members, 11 of whom shall be ex officio members, fourof whom shall be appointed by the Governor, 10 of whom shall be appointed bythe Speaker of the House of Representatives, and 10 of whom shall be appointedby the President Pro Tempore of the Senate. The ex officio members other thanthe Chief Medical Examiner shall be nonvoting members and may designaterepresentatives from their particular departments, divisions, or offices torepresent them on the Task Force. The members shall be as follows:
(1) The Chief MedicalExaminer;
(2) The AttorneyGeneral;
(3) The Director of theDivision of Social Services;
(4) The Director of theState Bureau of Investigation;
(5) The Director of theDivision of Maternal and Child Health of the Department of Health and HumanServices;
(6) The Director of theGovernor's Youth Advocacy and Involvement Office;
(7) The Superintendentof Public Instruction;
(8) The Chairman of theState Board of Education;
(9) The Director of theDivision of Mental Health, Developmental Disabilities, and Substance AbuseServices;
(10) The Secretary of theDepartment of Health and Human Services;
(11) The Director of theAdministrative Office of the Courts;
(12) A director of acounty department of social services, appointed by the Governor uponrecommendation of the President of the North Carolina Association of CountyDirectors of Social Services;
(13) A representative froma Sudden Infant Death Syndrome counseling and education program, appointed bythe Governor upon recommendation of the Director of the Division of Maternaland Child Health of the Department of Health and Human Services;
(14) A representative fromthe North Carolina Child Advocacy Institute, appointed by the Governor uponrecommendation of the President of the Institute;
(15) A director of a localdepartment of health, appointed by the Governor upon the recommendation of thePresident of the North Carolina Association of Local Health Directors;
(16) A representative froma private group, other than the North Carolina Child Advocacy Institute, thatadvocates for children, appointed by the Speaker of the House ofRepresentatives upon recommendation of private child advocacy organizations;
(17) A pediatrician,licensed to practice medicine in North Carolina, appointed by the Speaker ofthe House of Representatives upon recommendation of the North CarolinaPediatric Society;
(18) A representative fromthe North Carolina League of Municipalities, appointed by the Speaker of theHouse of Representatives upon recommendation of the League;
(18a) A representative fromthe North Carolina Domestic Violence Commission, appointed by the Speaker ofthe House of Representatives upon recommendation of the Director of theCommission;
(19) One public member,appointed by the Speaker of the House of Representatives;
(20) A county or municipallaw enforcement officer, appointed by the President Pro Tempore of the Senateupon recommendation of organizations that represent local law enforcementofficers;
(21) A district attorney,appointed by the President Pro Tempore of the Senate upon recommendation of thePresident of the North Carolina Conference of District Attorneys;
(22) A representative fromthe North Carolina Association of County Commissioners, appointed by thePresident Pro Tempore of the Senate upon recommendation of the Association;
(22a) A representative fromthe North Carolina Coalition Against Domestic Violence, appointed by thePresident Pro Tempore of the Senate upon recommendation of the ExecutiveDirector of the Coalition;
(23) One public member, appointedby the President Pro Tempore of the Senate; and
(24) Five members of theSenate, appointed by the President Pro Tempore of the Senate, and five membersof the House of Representatives, appointed by the Speaker of the House ofRepresentatives.
(c) All members of theTask Force are voting members. Vacancies in the appointed membership shall befilled by the appointing officer who made the initial appointment. Terms shallbe two years. The members shall elect a chair who shall preside for the durationof the chair's term as member. In the event a vacancy occurs in the chairbefore the expiration of the chair's term, the members shall elect an actingchair to serve for the remainder of the unexpired term.
