§77‑71. Authority to create Commission; withdrawal from and dissolutionof Commission.
The three counties may byjoint resolution create the Mountain Island Lake Marine Commission. Upon itscreation the Commission has the powers, duties, and responsibilities conferredupon it by joint resolution, subject to the provisions of this Article. Theprovisions of any joint resolution may be modified, amended, or rescinded by asubsequent joint resolution. A county may unilaterally withdraw fromparticipation as provided by any joint resolution or the provisions of thisArticle, once the Commission has been created, and any county may unilaterallywithdraw from the Commission at the end of any budget period upon 90 days priorwritten notice. Upon the effectuation of the withdrawal, the Commission isdissolved, and all property of the Commission must be distributed to or dividedamong the three counties and any other public agency or agencies serving theMountain Island Lake area in a manner considered equitable by the Commission byresolution adopted by it prior to dissolution.
