§74‑24.14. Criminal penalties.
Any person who (i) willfullyviolates any standard, order, notice, decision, rule, or regulation issuedunder authority of this Article, and said violation causes death or seriousphysical harm to another; (ii) knowingly makes any false statement,representation, or certification in any application, record, report, plan, orother document filed or required to be maintained pursuant to this Article orrequired by any order, notice, or decision issued under this Article; (iii)knowingly distributes, sells, offers for sale, introduces, or delivers anyequipment, machinery, article, or apparatus which is represented as complyingwith the provisions of this Article, or with any specification or regulation ofthe Commissioner applicable to such equipment, machinery, article, or apparatusand knowing it does not so comply, shall be guilty of a Class 2 misdemeanor. In any instance in which such offense is committed by a corporation, theofficer or authorized representative of such corporation who knowingly permitssuch offense to be committed shall, upon conviction, be subject to the samefine or imprisonment, or both.
