§ 62A‑48. Recovery ofunauthorized use of funds.
The 911 Board must givewritten notice of violation to any voice communications service provider orPSAP found by the 911 Board to be using monies from the 911 Fund for purposesnot authorized by this Article. Upon receipt of notice, the voicecommunications service provider or PSAP must cease making any unauthorizedexpenditures. The voice communications service provider or PSAP may petitionthe 911 Board for a hearing on the question of whether the expenditures wereunauthorized, and the 911 Board must grant the request within a reasonableperiod of time. If, after the hearing, the 911 Board concludes the expenditureswere in fact unauthorized, the 911 Board may require the voice communicationsservice provider or PSAP to refund the monies improperly spent within 90 days.Money received under this section must be credited to the 911 Fund. If a voicecommunications service provider or PSAP does not cease making unauthorizedexpenditures or refuses to refund improperly spent money, the 911 Board mustsuspend funding to the provider or PSAP until corrective action is taken.
