§58‑67‑145. Rehabilitation, liquidation, or conservation of healthmaintenance organization.
Any rehabilitation,liquidation or conservation of a health maintenance organization shall bedeemed to be the rehabilitation, liquidation, or conservation of an insurancecompany and shall be conducted under the supervision of the Commissionerpursuant to the law governing the rehabilitation, liquidation, or conservationof insurance companies, except that the provisions of Articles 48 and 62 ofthis Chapter shall not apply to health maintenance organizations. TheCommissioner may apply for an order directing him to rehabilitate, liquidate,or conserve a health maintenance organization upon one or more grounds set outin Article 30 of this Chapter or when in his opinion the continued operation ofthe health maintenance organization would be hazardous either to the enrolleesor to the people of this State.
