§58‑63‑70. Health care service discount practices by insurers andservice corporations.
(a) It is an unfairtrade practice for any insurer or service corporation subject to this Chapterto make an intentional misrepresentation to a health care provider to theeffect that the insurer or service corporation is entitled to a certainpreferred provider or other discount off the fees charged for medical services,procedures, or supplies provided by the health care provider, when the insureror service corporation is not entitled to any discount or is entitled to alesser discount from the provider on those fees.
(b) It is an unfairtrade practice for any person with knowledge that an insurer or servicecorporation intends to make the type of misrepresentation prohibited insubsection (a) of this section to provide substantial assistance to thatinsurer or service corporation in accomplishing that misrepresentation.
