§ 58‑50‑225. North Carolina Health Insurance Risk Pool Fund.
(a) The North CarolinaHealth Insurance Risk Pool Fund is established and consists of the followingrevenue:
(1) Premiums, fees,charges, rebates, refunds, and any other receipts occurring or arising inconnection with the Pool.
(2) The revenuetransferred to the Fund under G.S. 105‑228.5B.
(3) Gifts, grants, andother appropriations.
(4) Any interest earnedby the Fund.
(b) Disbursements fromthe Fund shall include the amounts required to pay the claims, benefits, andadministrative costs as may be determined by the Executive Director and theBoard.
(c) For the purposes ofproviding the funds necessary to carry out the powers and duties of the Pool,effective July 1, 2008, the Teachers' and State Employees' Comprehensive MajorMedical Plan and any successor Plan shall pay an annual surcharge to the NorthCarolina Health Insurance Risk Pool Fund in the amount of one dollar and fiftycents ($1.50) per member per year based on enrollment of active employee Planmembers and their dependents covered under the Plan.
