§ 58‑39‑40. Investigative consumer reports.
(a) No insuranceinstitution, agent, or insurance‑support organization may prepare orrequest an investigative consumer report about an individual in connection withan insurance transaction involving an application for insurance, a policyrenewal, a policy reinstatement, or a change in insurance benefits unless theinsurance institution or agent informs the individual:
(1) That he may requestto be interviewed in connection with the preparation of the investigativeconsumer report; and
(2) That upon a requestpursuant to G.S. 58‑39‑45 he is entitled to receive a copy of theinvestigative consumer report.
(b) If an investigativeconsumer report is to be prepared by an insurance institution or agent, theinsurance institution or agent shall institute reasonable procedures to conducta personal interview requested by an individual.
(c) If an investigativeconsumer report is to be prepared by an insurance‑support organization,the insurance institution or agent desiring such report shall inform theinsurance‑support organization whether a personal interview has beenrequested by the individual. The insurance‑support organization shallinstitute reasonable procedures to conduct such interviews, if requested. (1981, c. 846, s. 1; 2003‑262,s. 2(1).)
