§58‑25‑65. Appointment of trustees to hold property.
The lodges of Masons, OddFellows, Knights of Pythias, camps of Woodmen of the World, councils of theJunior Order of United American Mechanics, orders of the Elks, Young Men'sChristian Associations, Young Women's Christian Associations and otherbenevolent or fraternal orders and societies may appoint from time to timesuitable persons trustees of their bodies or societies, in such manner as theydeem proper, which trustees, and their successors, shall have power to receive,purchase, take, and hold property, real and personal, in trust for such societyor body. The trustees shall have power, when instructed so to do by resolutionadopted by the order, society or body which they represent, to mortgage or selland convey in fee simple any real or personal property owned by the order,society or body; and the conveyances so made by the trustees shall be effectiveto pass the property in fee simple to the purchaser or to the mortgagee ortrustee for the purposes in such conveyance or mortgage expressed. If thereshall be no trustee, then any real or personal property which could be held bysuch trustees shall vest in and be held by such charitable, benevolent,religious, or fraternal orders and societies, respectively, according to suchintent.
