§ 53‑208.17. Confidentiality of data submitted to the Commissioner.
(a) Notwithstanding anyother provision of law, all information or reports obtained by the Commissionerfrom an applicant, licensee, or authorized delegate, whether obtained throughreports, applications, examination, audits, investigation, or otherwise,including (i) all information contained in or related to examination,investigation, operating, or condition reports prepared by, on behalf of, orfor the use of the Commissioner; and (ii) financial statements, balance sheets,or authorized delegate information are confidential and may not be disclosed bythe Commissioner or any officer or employee of the Commissioner. TheCommissioner, however, may provide for the release of information torepresentatives of State or federal agencies who state in writing under oaththat they will maintain the confidentiality of the information if: (i) thelicensee provides consent prior to the release; or (ii) the Commissioner findsthat the release is reasonably necessary for the protection of the public or inthe interests of justice.
(b) Nothing in thissection shall prohibit the Commissioner from releasing to the public a list ofpersons licensed under this Article or aggregated financial data on those licenses.(2001‑443,s. 2.)
