§ 50‑42.2. Notice.
(a) A person initiatesan arbitration proceeding by giving written notice to the other parties to theagreement to arbitrate in the manner in which the parties have agreed or, inthe absence of agreement, by certified or registered mail, return receiptrequested, or by service as authorized for the commencement of a civil actionunder the North Carolina Rules of Civil Procedure.
(b) Unless a personobjects to the lack or insufficiency of notice not later than the beginning ofthe hearing, the person's appearance at the hearing waives the objection.
(c) Except as otherwiseprovided in this Article, a person gives notice to another person by takingaction that is reasonably necessary to inform the other person in the ordinarycourse of business, regardless of whether the person acquires knowledge of thenotice.
(d) A person has noticeif the person has knowledge of the notice or has received notice.
(e) A person receivesnotice when it comes to the person's attention or the notice is delivered atthe person's place of residence or place of business or at another locationheld out by the person as a place of delivery of communications. (2005‑187, s. 1.)
