§45‑21.41. Orders signed on days other than first and third Mondaysvalidated; force and effect of deeds.
In all actions for theforeclosure of any mortgage or deed of trust which has heretofore beeninstituted and prosecuted before the clerk of the superior court of any countyin North Carolina, wherein the judgment confirming the sale made by thecommissioner appointed in said action, and ordering the said commissioner toexecute a deed to the purchaser, was signed by such clerk on a day other thanthe first or third Monday of a month, such judgment of confirmation shall beand is hereby declared to be valid and of the same force and effect as thoughsigned and docketed on the first or third Monday of any month, and any deedmade by any commissioner or commissioners in any such action where theconfirmation of sale was made on a day other than a first or third Monday ofthe month shall be and is hereby declared to have the same force and effect asif the same were executed and delivered pursuant to a judgment of confirmationproperly signed and docketed by the clerk of the superior court on a first orthird Monday of the month.
