§28A‑6‑2. Letters issued without notice; exceptions.
Letters of administration orletters testamentary may be issued without notice, except:
(1) When the applicantis not entitled to priority of appointment under G.S. 28A‑4‑1, allpersons entitled to an equal or higher preference shall be given notice bycitation as provided in G.S. 28A‑5‑2(b)(1), unless they haverenounced in accordance with the provisions of Article 5 of this Chapter.
(2) The clerk ofsuperior court may in any case require that notice be given to such interestedpersons as he in his discretion may designate prior to the granting of letters.(1973, c. 1329, s. 3.)
