§ 28A‑13‑2. General duties; relation to persons interested in estate.
A personal representative is afiduciary who, in addition to the specific duties stated in this Chapter, isunder a general duty to settle the estate of his decedent as expeditiously andwith as little sacrifice of value as is reasonable under all of thecircumstances. He shall use the authority and powers conferred upon him by thisChapter, by the terms of the will under which he is acting, by any order ofcourt in proceedings to which he is party, and by the rules generallyapplicable to fiduciaries, for the best interests of all persons interested inthe estate, and with due regard for their respective rights.
