§ 162B‑7. Definitions.
Unless otherwise clearly required by the context, as used in thisArticle:
(1) "Attack" means any attack or series of attacks byan enemy of the United States upon the State of North Carolina causing, orwhich may cause, substantial damage or injury to civilian property or personsin the State in any manner by sabotage or by the use of bombs, missiles,shellfire, or atomic, radiological, chemical, bacteriological or biologicalmeans or other weapons or processes.
(2) "Emergency interim successor" means a persondesignated pursuant to this Article, in the event the officer is unavailable,to exercise the powers and discharge the duties of an office until a successoris appointed or elected and qualified as may be provided by the statutes,charters and ordinances or until the lawful incumbent is able to resume theexercise of the powers and discharge the duties of the office.
(3) "Office" includes all local offices, the powersand duties of which are defined by statutes, charters and ordinances.
(4) "Political subdivision" includes counties, cities,towns, townships, districts, authorities and other municipal corporations andentities whether organized and existing under charter or general law.
(5) "Unavailable" means either that a vacancy inoffice exists and there is no deputy authorized to exercise all of the powersand discharge the duties of the office, or that the lawful incumbent of theoffice (including any deputy exercising the powers and discharging the dutiesof an office because of a vacancy) and his duly authorized deputy are absent orunable to exercise the powers and discharge the duties of the office.
