§ 159‑182. Offending officers and employees removed from office.
If an officer or employee of a local government or public authoritypersists, after notice and warning from the Commission, in failing or refusingto comply with any provision of this Chapter, he forfeits his office oremployment. The Commission may enter an order suspending the offender fromfurther performance of his office or employment after first giving him noticeand an opportunity to be heard in his own defense, pending the outcome of quowarranto proceedings. Upon suspending a local officer or employee under thissection, the Commission shall report the circumstances to the Attorney Generalwho shall initiate quo warranto proceedings against the officer or employee inthe General Court of Justice. If an officer or employee persists in performingany official act in violation of an order of the Commission suspending him fromperformance of his duties, the Commission may apply to the General Court ofJustice for a restraining order and injunction.
